Terms and Conditions for all Up-to-Date Offers

OS X Lion Up-To-Date Program 2 (purchase qualifying system on or after July 21, 2011. Must submit within 30 days of purchase of qualifying system).

This program entitles the purchaser of a qualifying product purchased on or after July 21, 2011, to upgrade to OS X Lion.

• OS X updates, which may currently be downloaded from www.apple.com or through Software Update, are not included in this program.
• To receive your OS X Lion upgrade, you must complete the order form and provide an electronic copy of a dated, itemized sales receipt indicating the marketing part number(s) of the qualifying product(s) purchased. Order acknowledgments, packing slips, and purchase order copies are not valid.
• Completed order form and dated, itemized sales receipt must be emailed within 30 days of product purchase to qualify for this program.
• This offer is good only in the United States (50 states and the District of Columbia) and Canada, and valid only in accordance with the terms set forth in this document.
• Void where prohibited by law or where otherwise restricted.
• Upon receipt of your completed order form and proof of purchase, a content code for OS X Lion, redeemable on the Mac App Store, will be emailed within 24 hours of order qualification.
• Your use of the content codes and the End User’s use of OS X Lion are governed by the terms and conditions of your agreement(s) with Apple Inc. including but not limited to the licensing terms that accompany the products as well as the terms and conditions for the Mac App Store found at www.apple.com/legal/itunes/ww/. To redeem your content codes you will need the latest version of the Mac App Store application, an Apple ID, and Internet access (fees may apply).
• You can create an Apple ID at http://appleid.apple.com. If your Mac did not come with the Mac App Store application, it is available as a software update for any Mac running OS X Snow Leopard at http://www.apple.com/mac/app-store/.
• Apple is not responsible for lost or stolen content codes.
• Content codes may not be resold and can only be redeemed by people above the minimum age specified by the terms and conditions of the Mac App Store in your country.
• Apple reserves the right to extend the product availability date and the shipment date for any orders under this program at Apple’s sole discretion, upon notice to you.
• Apple reserves the right to change the terms of this offer at any time without notice.
• Neither Apple nor any of Apple’s agents are responsible for any loss, destruction, or theft of your order form or delay in the submission or receipt of your order form.
• Incomplete or illegible order forms will not be accepted.
• Apple is not responsible for electronic duplication errors.
• No returns will be allowed.
• This offer is not valid in conjunction with any other offer from Apple.
• The OS X Lion software content code must be used solely with the products that qualify for this offer.
• This offer is limited to one OS X Lion content code per qualifying product purchased.
• This offer is applicable only to purchases by end users and not by resellers.
• Keep a copy of these Terms and Conditions as well as your completed order form for your records.
• Qualifying products must be purchased from Apple or an Apple Authorized Reseller located in the 50 United States, District of Columbia, or Canada.
• Submissions will not be returned and become the property of Apple.
• This offer is not valid on the purchase of used, auction, or demonstration equipment, except for Apple-certified refurbished products purchased directly from the Apple Online Store that do not include OS X Lion.
